“Fantasy MotoGP 2009” Terms and Conditions The Fantasy MotoGP 2009 (“the Game”) is a system across which, the users can carry out predictions in each of the events of the F.I.M. Road Racing World Championship Grand Prix, also known as MotoGP. 1. When you enter and participate in the Game, you are bound to play and accept that you must participate in the Game in accordance with these terms and conditions (the “Terms and Conditions”), the Rules of the Game (the “Rules”) and any other materials relating to the Game published on DORNA official website (the “Website”) including without limitation the list of the prizes. 2. There are two types of prizes: 2.1. The Prize for the winner of the round (round’s prize). 2.2. The Prize for the winners at the end of the season (season’s prize). 3. Participants under 18 years of age and/or not of full legal age (a “Minor”) must seek parental permission before applying and participating in the Game and expressly accepting the Terms and Conditions. 4. By submitting your prediction and accepting the terms and conditions you authorize the publication of your user name, country and score on motogp.com and any other third-party authorized sites included by not limited ( youtube.com, facebook.com, newsletters, etc). 5. DORNA reserves the right to suspend, interrupt or cancel the game and the prizes due to any unexpected cause without prior notice. 6. DORNA reserves the right to refuse to accept application of user names that are considered by DORNA in its sole discretion to be inappropriate or offensive. Unsuitable names will be deleted and the application will appear under a default name chosen by DORNA. Please bear this in mind when you choose the name for your registration to motogp.com. 7. All accepted and registered Participants will be notified by DORNA via e-mail. 8. DORNA shall not be liable for electronic acceptance messages which are either not received or wrongfully sent or are “undeliverable” or remain for any reason undelivered. 9. All winners will be notified by e-mail. All details of the prizes and in particular the terms of their attribution and use will be provided by notification to the winners. No interest will be paid on any prize. Prizes may not be Sold/transferred without the prior written consent of DORNA before being delivered. Participants cannot request a cash alternative or substitution of the prize. DORNA, at its sole discretion, reserves the right to substitute a prize of greater or equal value in particular if any prize cannot be awarded as described due to unavailability or other reason. 10. Prizes referred to on the Game Website will only be attributed to Participants with legal residence/domicile in any given territory where they can receive the prize. 11. Prizes pictured in Game materials are for illustration purposes only. Actual prizes may vary from the pictured prize. DORNA shall not be responsible for any costs or expenses ( such as delivery of the prize) not expressly mentioned in the Prize section. 12. In the event a Minor wins a prize, the participation in the Game has to be confirmed and the prize has to be accepted by his/her parent or legal guardian. 13. The acceptance of these Terms and Conditions constitutes permission for DORNA and any third party authorised by DORNA to use the names and photographs of Participants at its sole discretion for publicity purposes. In particular, DORNA intends to publish the winner’s name and, if available, a photo of the winner on the Game’s home page and other websites. By participating in the Game, each Participant explicitly agrees to use and publication of his/her name and image, if available a photo, on winning the Game, if this is required by DORNA. 14. The Game is not open to employees of DORNA SPORTS (and/or any employee of associated companies of DORNA), their relatives, agents or agents’ relatives or any employees of companies involved in the development or support of the Game website. 15. DORNA reserves the right to introduce new facilities/changes to enhance the Game. Details of such introductions will be published on the Game website and will amend or vary these Terms and Conditions and take effect from the date upon which such details are published on the Website. 16. DORNA may, at its sole discretion, suspend a Participant, amend or waive the Rules and/or the Terms and Conditions at any time or cancel the Game at any time in the event of circumstances arising beyond DORNA’s control or which make it advisable to do so. The Participants agree that no liability shall attach to DORNA as a result thereof and that the exercise of such discretion shall not result in any compensation being payable or paid to any. 17. DORNA cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any Participant entering the Game or as a result of acceptance of any prize. DORNA is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to a Participant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in relation to the Game. By participating in the Game, you agree that no claim relating to any such loss or injury (including without limitation special, indirect or consequential losses) shall be asserted against DORNA, its parent companies, sponsors, affiliates, directors, officers, employees or agents. 18. DORNA reserves the right to take any decision in relation to any matter whatsoever in connection with the Game. No correspondence shall be entered into with any Participant. 19. Any legal dispute between the participant and DORNA in relation to the Game shall be governed by and interpreted in accordance with the laws of Spain. Place of jurisdiction shall be Madrid, Spain. DORNA shall also be at liberty to enforce its rights and to take legal action in any competent court of participants domicile. 20. These Terms and Conditions have been drafted in English and are available on the Website. The Participant acknowledges and agrees that he/she has read and understood these Terms and Conditions and that he/she is fully aware of the rights and obligations arising there from. 21. In case of draw between several participants, the winner will be the participant who has a better average. If the average of those participants with the same punctuation is the same, the winner of the prizes will be the user who has created his user account on motogp.com first. Same applies to the first Grand Prix where contestants do not have yet an average. 22. The scores will be established depending on the procedure explained in the paragraph of the game "How to play". 23. Users can change their results predictions as many times as desire as long as the period is open. Every time the configuration is changed the user will receive an email confirming the changes. DORNA reserves the right to close the prediction period anytime is needed. The remaining period will be announced on the site section. The last prediction is the one taken into consideration to determine the punctuation. Should DORNA not confirm the prediction, that one shall not be taken into account and is not valid. 24. When a race is canceled for whatever reason no claims can be me made against DORNA (weather, force majeure or any other reason). 25. The game closes before any race 20 minutes before the race. From that moment no bet can be made for such a race. 26. If there are last grid changes and the game is closed no change can be made. 27. If technical problems are detected calculating the number of points each user got DORNA reserves the right to decide to apply and dedicate its best efforts to find the best solution at its own discretion. 28. The results will be delivered the Monday following to the race, by e-mail and after 1 weeks the name of the winners will be announced and published in the Webpage and DORNA will communicate as well the winner personally via e-mail. In case of disqualifications, or special situations concerning the results, or scores DORNA will try to apply again the solution that it considers to be appropriate .As standard rule, the results used as reference will be the results existents 24 hours after the race. The changes during such 24 hours, related the official championship for decisions of any type (for example FIM) will be used on the results for the Game. After the 24 hours, the result for the Game can be different from the official result of the FIM. This includes rider ́s disqualifications and special situations. 29. No claim about the Game and/or the Results will be considered, it being agreed that DORNA is the only party entitled to value and determine the results of the Game. Participant agrees not to claim for such circumstances. 30. Once the email to the winner of the round’s prize has been sent, the user must respond that email in order to set up the delivery details within 1 month .Should no answer arrive during such first month, the winner waives the prize, witch will be give to the second qualified. Once the email to the winner of the season’s prize has been sent, the user must respond that email in order to set up the delivery details within 3 months. Should no answer arrive during such 3 months, the winner waives the prize. 31. DORNA is not responsible if the delivering company does not achieve to deliver the prizes to the winner. 32. DORNA is not responsible in case of loss (email, password) of the user’s account. 33. The users will have to provide correct information in the register process of the Website, in order to a correct delivery of the prizes. In case of false information, it will be understood as a renounce of the prize. 34. Participating and accepting this conditions the Participant expressly grants in exclusivity to DORNA and/or any of its affiliated companies, as organizer of the MotoGP, its image and voice rights arising out from his/her presence in the MotoGP (in perpetuity and worldwide) of whatever registrations and/or audiovisual recording (whatever it may be its support), for any and all uses, including but not limited commercial and publicity uses, in any now known or in the future developed support or media. The Participant expressly acknowledges that DORNA have the right use the Participant’s name, image, voice and biographic data derived from his/her presence into the MotoGP; as well as its use in all advertising and promotion of DORNA and/or any motor sports event or exhibition produced, presented or promoted by DORNA and/or any of its affiliated companies.
